ABSENCE WITHOUT LEAVE
Often employees fail to notify employers of absence or of their intention to leave, which leaves the employer unclear of the reasons for the absence or whether the employee has left or not.
In order to avoid potentially costly unfair dismissal claims an employer should not just assume that an employee has left and send their P45 ending their employment.
The employer should not just do nothing. If the employee does not return to work or make any contact it is important for the employer to try and contain by means of telephone, text, letter or e-mail.
If the employee still fails to respond to these attempts at communication the employer should go through a fair and proper process to properly terminate an employee’s employment in these circumstances.
The letters that can be downloaded will assist through this process but employers should contact the advice service to ensure that they are following a proper process.
Employers should always try and ensure that their employee handbook contains a policy which sets out the position in the event of absences of this nature.
